1. Introduction

   Welcome to Firestarter! These Terms of Service ("Terms") govern your use of the Firestarter Twitch Extension (referred to as "Extension","Firestarter", "Service", "we", "us", or "our"), and any related services provided by Hammertime e.U. By accessing or using our Extension, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Extension. Please read these Terms carefully before accessing or using our Services.
   
   

2. Use of Our Extension

   Use of the Firestarter Extension requires an active account with Twitch.tv ("Twitch"). By using the Extension, users affirm they possess a Twitch account in good standing.
   
   Upon first use of the Extension on Twitch, a corresponding user account for the Extension will be automatically generated. This account is uniquely linked to the user's Twitch account, without the necessity for additional credentials.
   
   The Extension does not permit users to modify their account name, password, or any associated data. The Extension operates on a read-only basis with respect to user data, ensuring privacy and security. User identification and management are conducted exclusively through the Twitch account, with no provision for custom account creation or management by users.
   
   

3. Functionality

   The Extension allows users to interact with the Twitch stream in real-time by utilizing Twitch's internal currency, bits, to activate features such as firing rockets on the stream overlay. The Extension reads the last bits used by the user to enable this interaction.
   
   In addition to the bits-based interactions, the Extension incorporates an internal point system. This system awards points to users based on their engagement with the Twitch stream. The allocation of points is determined by the Extension's proprietary algorithm, which may consider factors such as viewership duration and interaction frequency. Points are awarded periodically and are intended to enhance the user experience without requiring financial expenditure.
   
   The internal point system of the Extension is provided free of charge. Users are not required to make any purchase or payment to participate in this system
   
   Hammertime e.U. reserves the right to modify or discontinue, temporarily or permanently, the Extension or any part thereof, with or without notice. Users agree that Hammertime e.U. shall not be liable to them or to any third party for any modification, suspension, or discontinuance of the Extension
   
   

4. Payment

   Transactions within the Firestarter Extension are conducted exclusively through the use of "bits". Users wishing to engage in activities that require payment within the Extension must do so by utilizing bits in accordance with Twitch's terms and policies. For detailed information on acquiring and using bits on Twitch, users are directed to consult the Twitch Bits Policy.
   
   The Firestarter Extension operates within the Twitch ecosystem and adheres to Twitch's policies regarding transactions made with bits. Given the nature of these transactions, refunds of bits used within the Extension are not directly managed by the Firestarter Extension. In cases where there are issues with the Extension's functionality that affect the use of bits, the Extension may, at its sole discretion, offer compensation through the allocation of internal points within the Extension's point system
   
   It is important to note that the Firestarter Extension does not offer cash refunds for transactions conducted with bits. Users are encouraged to review Twitch's refund policy regarding bits for more information.
   
   

5. User Conduct

   Users of the Firestarter Extension are expected to engage with the Twitch community in a manner that is respectful, positive, and conducive to a welcoming environment. The primary function of the Extension is to allow users to launch rockets using Twitch bits on the stream, enhancing the interactive experience for both streamers and their audiences.
   
   Users must interact with others in a respectful and courteous manner at all times. Harassment, bullying, and derogatory language are strictly prohibited. Efforts should be made to contribute positively to the community, encouraging enjoyable and inclusive interactions.
   
   The Extension should be used as intended and not for any activities that could disrupt the stream or negatively impact other users. The following actions are explicitly prohibited and may result in immediate suspension or termination of access to the Extension:
   
   - Engaging in harassment, threats, or abuse toward other users or streamers
   
   - Using the Extension to conduct or promote illegal activities
   
   - Attempting to exploit or hack the Extension for unintended use
   
   - Creating or distributing content through the Extension that is discriminatory, obscene, or offensive
   
   Violation of these user conduct guidelines will result in corrective actions, which may include, but are not limited to, temporary suspension of access to the Extension, permanent ban from using the Extension. Users are encouraged to report any behavior to hello@hammertime.studio
   
   

6. Minimum Age Requirements

   To use or access the Firestarter Twitch Extension, users must meet minimum age requirements. Users must be at least 13 years of age. Individuals who are between 13 and 18 years old (or the age of majority in their jurisdiction) must have permission from their parent or legal guardian to use the Extension. By accessing or using the Firestarter Extension, you represent and warrant that you meet these age requirements and that you have received consent from your parent or guardian if you are under the age of majority in your jurisdiction.
   
   

7. Monitoring

   Firestarter is not required to oversee the Services, but retains the authority to inspect communications sent via the Services and to delete or block content at its discretion, including for security monitoring. Firestarter may disclose information as required by law, regulatory mandates, legal proceedings, or government demands, and holds the right to modify, reject, or remove content, either partially or entirely, based on its own judgment.
   
   

8. Intellectual Property

   All content provided through the Firestarter Extension, including but not limited to audio clips, images, videos, logos, icons, and any user-generated content, is the property of Hammertime e.U. Users are granted a limited, non-exclusive, non-transferable license to access and use the Extension content in accordance with these Terms
   
   Users who believe that their intellectual property rights have been infringed in any way through the Extension are encouraged to contact Hammertime e.U. to report their concerns.
   
   

9. Access Control

   Firestarter holds the exclusive right to revoke your access to the Services, along with any associated services, at any moment and without prior warning. Moreover, your rights will cease immediately if you violate any of the Terms outlined herein.
   
   

10. Translation

    The original language of these Terms of Service is English. While we may provide translations into other languages, should there be any discrepancies or conflicts between a translated version and the English version, the English version will take precedence
